KP Chief Minister challenged violation of Elections Rules 2017 in Peshawar High Court

PESHAWAR: The Chief Minister of Khyber Pakhtunkhwa, Ali Amin Gandapur, challenged the Election Rules 2017, which clearly state that a political party must have electoral symbols, while these rules were violated by denying the symbol to PTI contrary to the rules 2017.

Peshawar High Court, Justice Sahibzada Asadullah and Justice Farah Jamshed heard Chief Minister Ali Amin Gandapur’s petition against the election rules. Hearing the petition Peshawar High Court issues a notice to the Election Commission over the Chief Minister’s election rules plea. The lawyer of the petitioner told the court that they have challenged the election rules, PTI is a political party, while all members have been considered independent.

The Advocate General told the court that this case is very important, there is a Senate election on the 21st, there is a conflict between the election rules and the act, in the election rules 2017, an election symbol is necessary for a political party, while the election act does not require a political party to have an election symbol, in such a case, the election act will be given priority over the rules, PTI was deprived of reserved seats for this reason.

In the Supreme Court decision, the members of the Tehreek-e-Insaf have been declared independent members, inquiring about the arguments of the lawyer, the petitioner and the Advocate General in the court, Justice Sahibzada Asadullah said that this is your position, we will also hear the opposing party, to whom they would issue a notice in this, so that they can hear them. The court issued notices to the Election Commission and other parties and adjourned the hearing till Monday.
