Peshawar High Court questions arrest of beggar under MPO, seeks records

PESHAWAR: The Peshawar High Court PHC  has summoned records from the Deputy Commissioner regarding the arrest of a beggar under Section 3 of the Maintenance of Public Order (MPO) Ordinance.

The court heard a petition challenging the arrest, filed by the beggar’s lawyer, who argued that over 300 people, including the petitioner, were arrested under the MPO despite posing no threat to public order.

The lawyer contended that the MPO was misused and requested the court to declare the arrest illegal.

Additional Advocate General Syed Sikandar Hayat Shah stated that the arrests were made due to public order concerns.

However, Justice Sahibzada Asadullah questioned the legal basis for detaining beggars under the MPO, noting that separate laws govern beggars.

The court postponed the hearing, requesting detailed records and a report on MPO arrests.
