Peshawar: The Peshawar High Court PHC has temporarily stopped the eviction of Dr. Samia Abid, an associate professor at Khyber Medical College (KMC), from her official residence. The court issued the stay order after hearing her petition, which challenges a dispute over the ownership of the residence between KMC and the Postgraduate Medical Institute (PGMI).

During the hearing, Dr. Samia Abid’s lawyer, Noman Mohib Kakakhel, argued that the ownership of the residence (House R28) is under dispute between PGMI and KMC. However, Dr. Abid, who lives in the house and is directly affected, was not informed or given a chance to present her case in recent decisions regarding the property.

Kakakhel also mentioned that the property, located on the university campus, is part of a larger dispute involving several institutions, including Islamia College, the University of Peshawar, the University of Agriculture, the University of Engineering, and KMC. He revealed that he has represented various parties in this ongoing dispute. The case was previously referred to the Chief Minister and his cabinet for resolution, but Dr. Abid was not given an opportunity to be heard.

The lawyer further stated that Dr. Abid had earlier won a case in the civil court, which ruled in her favor, allowing her to occupy the residence. She also spent her own money to make the house livable.

After considering the arguments, the court ordered that the current situation be maintained, meaning Dr. Abid will not be evicted from the residence for now. The court also issued notices to Islamia College, the University of Peshawar, KMC, and PGMI, directing them to appear in court on April 8 for further proceedings.

The case highlights a long-standing property dispute among educational institutions, with Dr. Abid caught in the middle as she fights to retain her official residence.
