PESHAWAR: Peshawar High Court (PHC) on Wednesday heard a writ petition against elevating the junior judges to the Supreme Court and appointing a junior judge as acting Chief Justice of the high court.
A two-member bench comprising Justice Syed Arshad Ali and Justice Fazal Subhan heard the petition.
The petitioner’s lawyer, Malik Suleman, informed the court that the challenge was against the seniority of the judges and the appointment of the acting Chief Justice of the PHC. He said that senior judges were bypassed by evaluating junior judges to the top court and appointing a junior judge as chief justice of the Peshawar High Court.
He told the court that he had gathered the necessary documents regarding the seniority list, but the Registrar’s Office had raised objections on the writ petition.
He said that the petitioner had not received a copy of the objections yet. Once he received a copy, the objections will be addressed. Therefore, he is requesting for more time.
The court, while accepting the petitioner’s request, gave the petitioner time to remove the objections of the Registrar’s Office.
The petitioner’s Mufti Noorul Basar has made the federal government, president, prime minister, Chief Justice of Pakistan, chairman Senate, parliamentary committee, Judicial Commission of Pakistan and a judge among others as respondents.

The petitioner’s lawyer Malik Suleman told the court that we have challenged the seniority of the judges and the appointment of the acting Chief Justice. We have collected the necessary documents related to the seniority list. The Registrar’s Office has objected to them. We have not received the copy yet. If we receive the copy, we will remove the objections of the Registrar’s Office. We should be given some time.
