Peshawar High Court (PHC) Nullifies Decision on Reserved Seats Distribution, Orders Redistribution

The Peshawar High Court has accepted a petition from the Pakistan Muslim League-Nawaz (PML-N) and declared the Election Commission’s February 22, 2024, decision regarding the distribution of reserved seats in the provincial assembly null and void.

The court has directed the Election Commission to redistribute the reserved seats by constitutional and legal requirements within the next ten days, following hearings with all parties or their representatives.

In a brief, two-page written ruling, Justice Arshad Ali stated that the Election Commission’s current decision violates Article 106 of the Constitution and Rule 92 of the Election Act of 2017.

The court emphasised that women and minorities must receive their rightful allocation of reserved seats as mandated by law.

Furthermore, the court has prohibited the concerned parties from taking an oath to ensure that transparency and legal requirements are upheld in the upcoming political process.
