PHC seeks federal govt reply on plea against PECA Act

The Peshawar High Court (PHC) has directed the Khyber Pakhtunkhwa (KP) government and related authorities to respond to a legal challenge against a recent amendment permitting Members of the National Assembly (MNAs) to chair District Development Advisory Committees (DDACs).

A two-judge bench, led by Justices Muhammad Naeem Anwar and Kamran Hayat Miankhel, heard the petition filed by Advocate Sultan Muhammad Khan, which argues the amendment violates constitutional principles. The petitioner claims only the National Assembly can legislate on matters involving MNAs, not provincial governments.

The controversy began when the KP government initially appointed an MNA as a DDAC chairman. After a court challenge, the province amended its laws to legalize such appointments. The petitioner now seeks to nullify the amendment, calling it “unlawful.”
