PHC reserves verdict to stop disqualification of Sunni Ittehad Council members

PESHAWAR: Peshawar High Court (PHC) reserved virdicts in the disqualification pettition filed by Sunni Ittehad Council leader Hamid Raza and members of the assembly Rai Hassan Khan, Rai Murtaza Iqbal, Rai Haider Ali, Rai Ansar Iqbal, against the Election Commission’s disqualification.

The petition lawyer said that after the conviction from the Anti-Terrorism Court, Faisalabad, the Election Commission disqualified the petitioners on August 05 and held elections in their constituencies.

He said that they were in such a hurry, they did not even wait for our appeal, the petitioner’s lawyer.

Justice Waqar Ahmed, is it our jurisdiction if we stop elections in 05 constituencies of Punjab? However, the election commission asked that the conviction take place in Punjab, the election took place in Punjab, and they should go there for relief, too.

If they do not get relief from there, then they should come here. This petitioner is a convicted person, and a convicted person cannot get this relief, the Deputy Attorney General said. Thus, hundreds of conviction orders are suspended every day being suspended,

Justice Waqar Ahmed said that the Lahore High Court allowed convicted Ishaq Dar to contest elections and become a senator. The Lahore High Court said that a fugitive can contest elections, when millions of people elect a member, these voters also have rights in it, Justice Waqar Ahmed said.

The Deputy Attorney said that the Supreme Court has said in several decisions that a convicted person cannot get this relief. The Election Commission has suspended the election schedule of Zartaj Gul’s constituency, she is from Punjab, the petitioner’s lawyer said.

The court replied that at that time, no one raised any objection from the Election Commission. The court reserved the decision after hearing the arguments of the lawyers of the parties.
